Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “User”) and Tele Teta LTD, registration number 16074271, operating under the brand name SafeCloud (“SafeCloud”, “Company”, “we”, “us”, or “our”).

By accessing, ordering, or using any SafeCloud services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the services.

2. Scope of Services

SafeCloud provides cloud-based digital infrastructure services, including but not limited to:

  • Shared and virtualized computing environments
  • Compute instances
  • SSL/TLS certificates
  • Professional email and messaging services

Services are provided on a self-service, automated basis. SafeCloud does not create, review, manage, or endorse any Customer content, applications, data, or activities conducted using the services.

The Customer is solely responsible for system configuration, data management, security practices, and compliance with applicable laws.


3. Account Registration and Responsibility

To use the services, Customers must create an account and provide accurate, complete, and up-to-date information.

The Customer is responsible for maintaining the confidentiality of account credentials and for all activities occurring under their account, whether authorized or unauthorized.

SafeCloud shall not be liable for losses caused by compromised credentials or Customer negligence.


4. Acceptable Use Policy

The Customer agrees not to use SafeCloud services for any unlawful, prohibited, or abusive activities, including but not limited to:

  • Violation of local, national, or international laws or regulations
  • Fraud, phishing, scams, impersonation, or deceptive practices
  • Distribution of malware, ransomware, spyware, or malicious code
  • Unauthorized access to systems, networks, or data
  • Network abuse, DDoS attacks, or traffic flooding
  • Copyright, trademark, or intellectual property infringement
  • Hosting illegal content or facilitating criminal activity

The Customer is solely responsible for ensuring that their use of the services complies with all applicable laws and third-party obligations.


5. Monitoring, Security, and Abuse Handling

To ensure platform security, service integrity, legal compliance, and payment processor requirements, SafeCloud may monitor network traffic patterns, system performance, and usage behavior.

Such monitoring is limited to operational and security purposes and does not constitute active content moderation or content ownership.

Any suspected abuse, security incident, or policy violation must be reported to: abuse@safecloud.az

SafeCloud reserves the right to immediately suspend, restrict, or terminate services without prior notice if prohibited activity, abuse, or risk to infrastructure is detected.


6. Payments, Billing, and Refunds

All services are billed in advance unless otherwise stated.

Payments are processed through authorized third-party payment providers, including but not limited to Stripe. SafeCloud does not store or process payment card data directly.

Failure to complete payment, chargebacks, or payment disputes may result in immediate service suspension or termination.

Except where required by law, all fees are non-refundable.


7. Service Availability and Maintenance

SafeCloud aims to provide high availability but does not guarantee uninterrupted or error-free operation.

Planned maintenance, emergency updates, hardware failures, network issues, or third-party dependencies may result in temporary service interruptions.

SafeCloud shall not be liable for downtime or data loss resulting from such events.


8. Data and Content Responsibility

Customers retain full ownership of their data.

SafeCloud is not responsible for backing up Customer data unless explicitly stated in a paid backup service agreement.

Customers are strongly encouraged to maintain independent backups.


9. Limitation of Liability

To the maximum extent permitted by law, SafeCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, loss of business, or service interruptions.

SafeCloud’s total liability for any claim shall not exceed the amount paid by the Customer for the affected service during the previous billing period.


10. Termination

Customers may terminate their account at any time through the account panel.

SafeCloud reserves the right to terminate or suspend accounts for violations of these Terms, non-payment, or legal compliance requirements.


11. Modifications to Terms

SafeCloud reserves the right to modify these Terms at any time.

Updated versions will be published on the website. Continued use of services after changes constitutes acceptance of the revised Terms.


12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws of the Company’s jurisdiction, without regard to conflict of law principles.
